These terms and conditions apply to the Diaclopedia app (hereby referred to as "Application") for mobile devices that was created by Diaclopedia (hereby referred to as "Service Provider") as an Ad Supported service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

1. Intellectual Property and Use License

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. Any charges for the Application or its services will be clearly communicated to you.

2. Data Processing and Device Security

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly.

4. In-App Purchases and Billing

The Application offers consumable digital content (points) through in-app purchases. All transactions are processed through the respective app stores (Apple App Store or Google Play Store). By initiating a purchase, you acknowledge that:

5. Points and Member-to-Member Point Transfers

Points are content and a digital means of use provided by the Service Provider within the Application. The Service Provider may offer a feature that allows a member to send some or all of their points to another member. The following applies to points and the use of the transfer feature:

  1. Nature of Points: Points are a means of use that may be accrued, used, consumed, or transferred within the Application in the manner and to the extent determined by the Service Provider. Points are not legal tender and do not, in themselves, represent any monetary claim. The Service Provider does not redeem points directly for legal tender. The specific methods of accrual, the places of use, and the functions of points — including transfers to other members and any additional features the Service Provider may offer in the future, such as exchange, conversion, or event entry — are determined by the Service Provider within the limits permitted by applicable law and announced within the Application, and the Service Provider may change or discontinue them in accordance with its service policy.
  2. Transfer Fees: A fee may be charged for a transfer. Unless otherwise specified, the fee is borne by the sending member, and the receiving member is credited with the transfer amount net of the fee. The applicable fee (rate) is displayed on the transfer screen; the Service Provider may change it in accordance with its policy and will provide notice in advance of any change.
  3. Finality and Irreversibility: Transfers are processed based on the information entered by the member and, once completed, cannot be cancelled or reversed. Fees deducted are likewise non-refundable. The Service Provider is not responsible for any loss arising from a member incorrectly specifying the recipient, amount, or other details.
  4. Prohibited Use: Members must not use the transfer feature for any of the following purposes:
    • Trading points for cash or cash-equivalent assets (so-called real-money trading) or exchanging them for cash;
    • Paying for goods or services, transferring or laundering funds, trading accounts, or any other purpose beyond the intended use of the Service;
    • Transferring or concentrating points through improper means, including the creation of multiple accounts or abnormal accrual and sending of points;
    • Any other act that violates applicable laws or these Terms.
  5. Service Provider's Right to Act: Where abuse is suspected or as necessary for the safe operation of the Service, the Service Provider may, without prior notice, set transfer limits, withhold, refuse, or cancel particular transfers, recover the points involved, or impose the sanctions set out in Section 10 (Community Board Policy).
  6. Recovery of Improperly Obtained or Used Points: Where it is objectively confirmed that a member has obtained or used points through abnormal means such as the following, the Service Provider may recover or deduct those points (including any amounts accrued as a result):
    • Using a system error, bug, abnormal transaction, or any method not intended by the Service Provider;
    • Obtaining points by misappropriating another person's identity, payment method, or account, or through fraudulent payment (such as using points after the payment has been cancelled or refunded);
    • Accruing, transferring, or concentrating points through improper means, including the creation of multiple accounts or the use of automated programs;
    • Violating paragraph 4 (Prohibited Use) or otherwise obtaining or using points through means that are improper or abnormal under generally accepted social norms.
    Where feasible, the Service Provider will notify the member of the reason before or after recovery, and the member may raise an objection and provide an explanation.
  7. Transferred Purchased Points and Refunds: Where purchased points are sent to another member, those points are deemed to have been used and are excluded from the right of withdrawal and refunds under Section 4. Points received by transfer do not belong to the member who purchased them, and the receiving member may not request a refund for such points.

6. Connectivity and Network Charges

Some functions of the Application require an active internet connection. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance. If you are using the application outside of a Wi-Fi area, your mobile network provider's agreement terms still apply, and you may incur charges for data usage or roaming. By using the application, you accept responsibility for any such charges.

7. Limitation of Liability

The Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

While the Service Provider strives to ensure that the Application is updated and accurate at all times, they rely on third parties to provide information. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on the functionality of the application.

8. Updates and Termination

The Service Provider may wish to update the application at some point. You agree to always accept updates to the application when offered. The Service Provider does not guarantee that it will always update the application to be compatible with your specific operating system version. The Service Provider may also cease providing the application and may terminate its use at any time without providing termination notice to you. Upon termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application and delete it from your device.

9. Account Withdrawal

Members may terminate their agreement at any time through the "Delete Account" feature within the application. Upon withdrawal, any points held and paid benefits such as ad removal will be forfeited and cannot be recovered. The handling of personal data upon withdrawal is governed by the Privacy Policy.

Upon withdrawal, posts and comments created by the member will not be deleted. Instead, the author information (such as nickname) will be anonymized and displayed as "Deleted User." This is to maintain continuity of community context, and anonymized content may continue to be visible within the Service.

10. Community Board Policy

The Application provides community features including posting and commenting. The following policies apply when using these features.

  1. Nickname: A nickname must be set once to use community features. Nickname changes are not currently supported.
  2. Post Creation Points: A certain amount of points may be deducted when creating a post. No points are required for editing, and points are not refunded upon deletion. The current point cost can be found on the post creation screen.
  3. Prohibited Content: Members must not include the following in any content created within the service, including nicknames, posts, and comments:
    • Profanity, abusive language, hate speech, or content that defames or slanders others
    • Sexually explicit content or content that causes sexual humiliation
    • False information or content that may mislead others
    • Advertisements, spam, or repetitive identical content
    • Content that violates the personal information or privacy of others
    • Content that violates applicable laws and regulations
  4. Sanctions: If a member violates these Terms, including by posting prohibited content, the Service Provider may delete the content or suspend or delete the member's account without prior notice. In the event of account suspension or deletion due to the member's own fault, any points held will be forfeited, and refunds for purchased points are available only to the extent permitted by applicable law.
  5. Report Feature: Members may use the report feature if they believe another member's post or comment constitutes prohibited content. Reported content will be reviewed and appropriate action will be taken.
  6. Content Management: The Service Provider may monitor posts and comments to maintain a healthy service environment and may delete or modify content without prior notice when necessary.
  7. User Content Ownership and License: Copyright in posts and comments submitted by members within the Service ("User Content") remains with the respective member. However, by submitting User Content, you grant the Service Provider a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute your User Content for the purposes of operating, maintaining, improving, and promoting the Service. This license survives deletion of the content or termination of your account to the extent necessary for Service operation (e.g., maintaining context linked to other members' comments).
  8. Member Responsibility for Content: Members bear full legal responsibility for the content of their posts and comments. The Service Provider is not liable for any disputes or damages arising from User Content that infringes upon the copyright, reputation, or privacy of others.

11. Changes to These Terms

The Service Provider may periodically update their Terms and Conditions. You are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
